These General Terms and Conditions of Sale (“GTC”) apply to orders placed on the website https://www-apishop-v2.web-caisse.com/shop/pazzi-madridgaztambide (“the Site”) for pickup at the Pazzi store in Madrid. The Customer must be of legal age and have full legal capacity to enter into a contract. By confirming their order, the Customer declares that they have read and fully accepted these GTC, in accordance with Royal Legislative Decree 1/2007, dated November 16, which approves the Consolidated Text of the General Law for the Protection of Consumers and Users (TRLGDCU). The T&Cs in effect are those published on the date of the order and may be updated without retroactive effect on orders that have already been confirmed.
The Site offers only in-store pickup ("Click & Collect"). Home delivery is not available through this channel.
The Customer may browse the Site freely without any obligation to purchase. Before confirming the order, the Customer has the technical means to review and correct the contents of their shopping cart. Once confirmed, the order is final and must be paid for at the time of the online purchase using a credit card, Google Pay, Apple Pay, or Samsung Pay. The Customer receives an order confirmation via email with details of the products and the price.

This establishment does not sell alcoholic beverages.
Pickup takes place during the hours indicated on the Website, within the store’s hours of operation. The Customer has a 15-minute grace period from the pickup time indicated on their order to pick it up without any issues. If this grace period expires without the Customer having picked up the order, the Store may consider it unclaimed, subject to the dispute policy described in clause 6.
Unclaimed Orders — If the Customer has not picked up their order by the end of the 15-minute grace period specified in Clause 5, the Store reserves the right to discard the order for reasons of food quality and safety. The Store will not assume any liability for orders not claimed by the end of that period, and the Customer will not be entitled to a refund or subsequent delivery of the order.
Prices are listed in euros and include the VAT applicable on the date of the order. The invoiced price is the one indicated in the order confirmation. The Store reserves the right to change prices on the Site at any time, without this affecting orders that have already been confirmed.
Product availability is displayed in real time. In the event of an unexpected unavailability of a product or ingredient, the Store may remove the unavailable product from the order without prior notice to the Customer and will issue a refund for the corresponding amount within a maximum of 14 calendar days, using the same payment method used for the purchase.

For the supply of goods that may spoil or expire quickly, orders for fresh food products placed on the Site are binding and final upon confirmation, with no possibility of withdrawal, cancellation, return, or exchange once payment has been made.
In accordance with Articles 114 through 124 of the TRLGDCU (as amended by Royal Decree-Law 7/2021, transposing Directive (EU) 2019/771), the Store is liable for any lack of conformity of the product existing at the time of delivery, for a period of three years from the date of delivery, without prejudice to the specific provisions applicable to perishable food products, the conformity of which must be verified at the time of pickup.
The Customer has seventy-two (72) hours from the time the order is picked up to file any complaint regarding the products through the contact link on the Site. Once this period has elapsed, the products will be deemed to be in compliance, except in the case of a hidden defect.
In the event of a dispute that cannot be resolved directly with the Store, the Customer may turn to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/
These Terms and Conditions are governed by Spanish law. Without prejudice to the mandatory provisions protecting consumers under the Consolidated Text of the General Law on Consumer and User Protection (TRLGDCU) and Regulation (EU) No. 1215/2012, any dispute shall be submitted to the courts and tribunals of the Customer’s place of residence.
